I joked on Twitter the other day about a fictitious headline originating out of ILTA in DC with respect to my “outing” an old dear friend. It was a joke, of course. I’ve had the joy and privilege of that friendship for over a decade.
Yet it’s not all that hard to imagine something actionable being said on Twitter. “Nice Tweets” I digress.
People loose all sense (common and legal) in the cyberworld and they do it all the time.
Imagine using some-one’s tweets as a potential ESI target. Imagine getting served with a Summons/Complaint or Subpoena on this or other type of social networking site.
I have noticed for some time now how occasionally when something big happens in the news that involves an individual, quotes or photos from their FaceBook or MySpace pages hits the news, too. For better or worse, this is the digital age and I guess it’s all fair game. The story today over at Law.com is called The Smoking Gun in an Adversary’s Network and it’s a goodie. Daniel L. Brown and Aimee R. Kahn have gotten my attention this morning. A well thought out piece, I’d suggest you take a few minutes to read it and get away from the 9/11 memories for a few.
